Newly elected MP Amritpal Singh, who has been detained under the National Security Act (NSA) moved the Punjab and Haryana High Court after challenging the proceedings as well as his preventive detention.

Amritpal has been staying in Dibrugarh Jail since his arrest in April 2023. However, he won the 2024 Lok Sabha elections from Punjab’s Sri Khadoor Sahib parliamentary constituency as an Independent candidate. Singh is the chief of the alleged “pro-khalistani” outfit, Waris Punjab De and is also an accused in Ajnala Police Station attack incident.

The first detention order against Amritpal was passed in March 2023 after his alleged provocative speech.

According to a Live Law report, Amritpal while submitting his plea contended that his life and liberty was completely taken away in “an unusual and cruel manner” by applying the preventive detention law against him for more than a year and by also detaining him 2,600 km away from Punjab.

He further said that he took an oath under the Constitution and has acquired the “right to represent the best interest of his constituency and the state of Punjab.”

The plea also mentioned that Amritpal has been detained primarily on the basis of social media posts that were uploaded by different people across the world and it hardly has any practical impact in the state of Punjab. It also added that possibly “the security of the State of India cannot be so fragile that it can be impacted by social media posts.”

The plea also submitted that the District Magistrate of Amritsar can not issue any orders with respect to “Security of India” under section 3(3) NSA and only Central Government or State Government can issue the same under section 3(1) of NSA.

No material before the District Magistrate was there which can reach even the subjective conclusion that petitioner is acting in any manner prejudicial to the defense of India, the relations of India with foreign powers, of the Security of India, the plea further stated.
