The Trinamool Congress government in West Bengal moved the Supreme Court on Friday, challenging the Calcutta High Court decision directing a CBI probe in connection with the allegations of land grabbing and sexual assault in Sandeshkhali.
The plea filed by the Mamata Banerjee government will be heard by the apex court’s bench of justices BR Gavai and Sandeep Mehta on Monday, April 29.
In its plea, the West Bengal government said the High Court failed to consider the underlying political motive in the case.
Extensive steps have been taken by the state police in the present matter were completely ignored by the High Court, the Mamata government said, adding that the transfer of investigation to CBI in a cursory manner violates the law.
“Impugned Order, which on one hand has called for a report from the CBI on the investigation has further painted the entire state machinery at fault attributing culpability of the State Officials in the land grabbing allegations, which prima facie are unwarranted,” the plea said.
CBI Filed Case In Sandeshkhali Violence Case
The Central Bureau of Investigation (CBI) registered the first case in West Bengal’s Sandeshkhali related to the land grab and sexual assault allegations against five influential people on Thursday.
The case pertains to a land dispute where the women of the victim’s family had to allegedly face sexual assault from influential people in the area. CBI has not yet disclosed the identity of the five accused and the victims.
Calcutta HC Orders CBI Probe
The Calcutta High Court on April 10 ordered a court-monitored CBI investigation into allegations of crimes against women and land grabbing in West Bengal’s Sandeshkhali, saying an “impartial inquiry” was required in the interest of justice and fair play.
The High Court had also directed the CBI to file a comprehensive report on the alleged illegal conversion of agricultural land into water bodies for pisciculture after conducting a thorough inspection of revenue records and physical inspection of land alleged to have been converted.
The central agency has been tasked to investigate allegations of crimes against women and land grabbing in Sandeshkhali and submit a comprehensive report to it at the next date of hearing on May 2.
