New Delhi: A Delhi court on Monday will decide whether Maoist ideologue Kobad Ghandy can be prosecuted under the stringent anti-terror law of Unlawful Activities Prevention Act (UAPA).
The court had earlier declined from framing charges against Ghandy under the law due to a procedural goof-up by the police. The court said that there was no evidence to prosecute Ghandy.
The police filed a fresh plea after that.
The police had accused Ghandy of trying to set up a Naxal wing in Delhi. Ghandy is a Doon school alumnus and had studied in London. He was said to be part of the top leadership of erstwhile CPI-ML (People's War Group) from 1981 and continued as a Central Committee member in CPI (Maoist). He was elected to its Politburo in 2007.
The investigators had claimed to have recovered a fake voter identity and pan cards from Ghandy and had referred to a CD in which he was shown addressing the armed cadres of the banned organisation. He was arrested on September 20, 2009.
They had also pointed out that after his arrest, Jharkhand police inspector Francis Induwar was killed on October 6, 2011, and leaflets were distributed in Maharashtra calling for bandh in protest against his detention.
