KOCHI: The Kerala High Court on Monday dismissed the anticipatory bail petitions of  four accused police officers in a case relating to the custodial death of Sampath.The accused are Assistant Sub Inspector K Ramachandran, Civil Police officers K Madhavan, P A Abdul Rasheed and K S Shilan. They are absconding now. Justice K T Shankaran, while dismissing their bail pleas, said that allegation levelled against the accused were grave in nature and added that if they were granted bail it would adversely affect the investigation.The petitioners submitted that the CBI is partial towards the police officials involved in the murder case.  Even after obtaining the arrest warrant from the Magistrate, the CBI did not arrest the then Palakkad Superintendent of Police and the IG. To which the CBI submitted that it is the discretion of the investigating agency regarding whom to be arrested and in what manner investigation should be conducted. The agency further submitted that the accused could not dictate as to how the investigation should be carried out. “Howsoever improper may be the method adopted by the investigating agency in arresting some of the accused, that is not a ground for the petitioner to claim immunity from arrest,” the court said.
