KOCHI: The Kerala High Court on Thursday declined to issue an order on a petition seeking issuance of a clarification that the pendency of a case against the Skycity project would not be a bar on authorities concerned in considering the applications by Yashoram Infra Developers Private Ltd.A Bench comprising Acting Chief Justice Manjula Chellur and Justice V Chitambaresh declined the  plea of the company’s counsel for a clarification order in this regard.  The Indian Institute of Architects (IIA), Kochi Chapter, in a petition had challenged the government order granting approval to the proposed Skycity project. Counsel for the petitioner Sivan Madathil strongly opposed the plea of the company. He contended that the proposed project came within the Coastal Regulation Zone (CRZ), where construction activities are prohibited. The works on the Skycity project would cause adverse impact on the ecology of the district. He pointed out that no environment impact assessment study had been conducted properly. In fact, the project was proposed on public land which is being used by people for various purposes, including fishing, transportation and navigation. By issuing such an impugned order, the government intended to transfer the land and water body used by the public, to a private builder. The action of the government would set a bad precedence and would have disastrous consequences, the petitioner pointed out.The counsel for IIA sought a directive to the state government not to grant permission to proceed with the execution of the project. They also sought a declaration that the proposed project or any other project was not permissible in the backwater (Chilavannoor backwater) as the area comes CRZ.
