BANGALORE: In a significant development on Wednesday, Governor H R Bhardwaj accorded sanction to the Lokayukta to prosecute former minister Katta Subramanya Naidu and his son former BBMP corporator Katta Jagadish.
The duo have now moved the High Court with a fresh petition. The petitioner Katta Jagadish has challenged the Constitutional validity of 19(3) (C) under Prevention of Corruption Act as arbitrary, illegal, unjust and violating fundamental rights under Articles 14, l6, 21 of the Indian Constitution.The new judicial approach by Katta is in view of HC which recently vacated the stay on further proceedings against him; others subsequently followed by filing charge sheet.

On Thursday, four petitions were filed; one each by Katta Jagadish, Katta Surbramanya Naidu and two by two other accused. The petitions have challenged the Constitutional validity of Section 19 of the Prevention of Corruption Act, which makes it necessary for previous sanction for prosecution of a public servant.
