Raipur: Dr Binayak Sen has moved Chhattisgarh High Court against his conviction amd life sentence by the Raipur Additional District and Sessions Court for sedition and links with Naxals.

Sen's lawyer Mahendra Dubey filed an appeal at the Chhattisgarh High Court in Raipur on Wednesday saying his clients involvement in the alleged crime was not proved beyond reasonable doubt.

Dubey claimed in the appeal that that after a thorough examination of the lower court's judgement it has become clear Dr Sen's involvement in the alleged crime was not proved beyond reasonable doubt.

"Circumstantial evidence, which form the basis of the judgement, lack cohesion and arguments of the defence were ignored," Dubey said in the petition.

"The lower court neither properly followed the procedure laid down for trial of criminal offences nor explained the evidence adduced in accordance with law," the petition said.

Dr Sen along with Naxal ideologue Narayan Sanyal and Kolkata businessman Piyush Guha was sentenced to life after being held guilty of sedition and helping Naxals by the court of Additional District and Sessions Court of BP Verma in Raipur.

All the three were sentenced to life imprisonment under sections 124A and 120(B) of IPC. The trio was also found guilty under Section 8(1) of Chhattisgarh Special Public Security Act and awarded two years imprisonment and a fine of Rs 1,000.

They were sentenced to one year imprisonment and Rs 1000 fine under section 8(2) of the state Act, to three years prison term and a fine of Rs 1000 under section 8(3) of that Act and to five years imprisonment and fine of Rs 1000 under its Section 8(5).

All the three were also found guilty under provisions of Prevention of Unlawful Activities Act and sentenced upto five years jail term and a fine of Rs 1,000 each. Sanyal was also awarded 10 years imprisonment and a fine of Rs 2,000 under Section 20 of the Act.
