New Delhi: The Supreme Court said on Friday that the interview, which the Delhi braveheart's friend gave to a TV news channel, could not be used as evidence in the trial proceedings of the December 16 gangrape case. The apex court set aide the order of the Delhi High Court, where it had allowed the interview to be used as evidence in the case.
The male friend of the 23-year-old girl, who was gangraped by six men in a moving bus in Delhi, had criticised the police and the passersby for their indifference and delay in the interview. He had alleged that no passerby came forward to help them after he and his friend were thrown out of the bus for about 25 minutes. He also said that three police vans arrived after 45 minutes but wasted time in deciding the territorial jurisdiction of the police station under which the case falls.
The Delhi Police, however, had refuted the allegations of delay. Delhi Police PRO Rajan Bhagat had said, "The PCR call was recorded at 10:22:20 pm. The call was broadcasted to PCR vans and van Z-54 was directed to spot. Meanwhile PCR van E-42 reached spot on its own at 10:26 pm ie within 4 minutes. Van Z-54 reached spot at 10:28 pm ie within 5.5 minutes of call. It left the spot with victims at 10:31 pm ie within 3 minutes. It reached Safdarjang hospital within 24 minutes at 10:55 pm. All records as per GPS."
The young man was with the 23-year-old medical student when they boarded a bus around 9.00 pm in south Delhi's Munirka area after watching a movie in a cinema hall on December 16. The girl was gangraped and brutally assaulted by six men in the bus who also attacked her friend before dumping them on the road. The boy was badly injured in the incident.
