Ahmedabad: The Gujarat High Court will hear Additional Director General of Police PP Pandey's plea on Monday. He had moved the court, seeking quashing of the FIR filed against him by Central Bureau of Investigation (CBI) in the 2004 Ishrat Jahan encounter killing case.
A special CBI court had passed an order proclaiming a 1982-batch IPS officer Prithvipal P Pandey an absconder and also demanded action against him under Section 82 of Criminal Procedure Code (CrPC). He was directed him to appear before the court by July 31 to avoid further action.
If Pandey is declared an absconder and a proclaimed offender under this provision, the investigating agency can attach his properties if he does not appear before the investigating officer of the case within 30 days of declaration.
He has been made accused in the fake encounter case for providing "so-called crucial intelligence inputs" to fellow policemen that Ishrat and three others were LeT operatives and were on a mission to assassinate Chief Minister Narendra Modi.
Pandey was Joint Commissioner of Police when on June 15, 2004, Ishrat Jahan, Javed Shaikh alias Pranesh Pillai, Amjadali Akbarali Rana and Zeeshan Johar were killed in an encounter with the Gujarat police on the outskirts of Ahmedabad.
