A court sentenced a Pak couple to three years RI after they were found living unauthorisedly in Delhi.

New Delhi: A Delhi court has sentenced a Pakistani couple to three years rigorous imprisonment after it was found that they were living unauthorisedly in Delhi.

Metropolitan Magistrate S K Malhotra also imposed a fine of Rs 2000 on Masood Hassan and Shahnaj Parveen, Pakistani nationals, who had entered India on January 25, 1999, with a visa for 60 days.

"It has been duly proved that both the accused are foreigners (Pakistani citizens) having entered India on the strength of a Pakistani passport but they violated the condition of visa and lived unauthorizedly in Delhi after expiry of their visa," said the court.

The couple was given residential permits only for Bhopal and Meerut but they came directly to Delhi by a train and contravened their permit too, the court added.

The court further directed the Jail Superintendent of Tihar Jail, where they have been lodged after conviction, to arrange for their return to Pakistan after their sentence is over.

"After completion of sentence, Jail Superintendent is specifically directed to make necessary steps to depart the convicts from the territory of India", it said.

The court dismissed the defence contention that they were Indian citizens who had gone to Pakistan to meet relatives and after losing their passports had to return on a Pakistani passport.

The court lent credence to the deposition of the Sub-Inspector of Attari Railway Station, Amritsar, who produced in the court a copy of visa form of the couple.

The convicts had come to India via Attari and had been living in Gokulpuri area of East Delhi since 1999.
