Mumbai: Where is Daya Nayak? That's the question bothering the Mumbai police and the High Court.
The encounter specialist, whose bail plea was rejected by the Supreme Court on Friday, was supposed to surrender on Saturday, but did not turn up.
The Anti Corruption Bureau (ACB) has declared him an absconder. However, CNN-IBN has learnt that Nayak has strong intentions of surrendering in the court and fighting the case.
Meanwhile, public prosecutor Ramnath Kini has said, "A non bailbale warrant has been issued by the Mumbai Sessions Court for arresting Daya Nayak because he did not suurender and he is still absconding."
The Supreme Court had earlier granted Daya Nayak interim relief from police arrest but the Bombay High Court on February 8 had rejected his bail plea earlier also.
On February 8, the High Court had rejected the anticipatory bail pleas of Nayak and his alleged associate Rajendra Padate. However, on February 13, Nayak had moved the Apex Court against the Bombay High Court order.
The Supreme Court had granted Nayak and Padate a week's time to surrender. However, the court had granted anticipatory bail to Nayak's wife Komal.
Nayak, who has killed 83 gangsters in encounters during his decade-long career, has been accused of possessing assets disproportionate to his sources of income and has been booked under Prevention of Corruption Act.
According to the FIR registered on January 20 by the Anti-Corruption Bureau of the Mumbai Police, Nayak has assets worth over Rs 40 lakh, in excess of his legitimate income by over 200 per cent.
The 3 accounts are: A/c 013 - 361620 - HSBC Bank - Vile Parle West ; A/c 0202622 - 02 - Development Corporation Bank - Santacruz West ; A/c 20105- Dena Bank, Borivali West.
Komal Nayak is also the director of two finance companies - Ojus Finance and Kuber Housing Private Limited. When questioned she was unable to explain her source of income.
ACB also claims that Nayak owns a fleet of luxury tourist buses and a travel company in the name of Vishal Travels in Andheri.
He has a penthouse on Malad link road registered in the name of one of his relatives.
On his links with the film industry the ACB report states that he has financed two films, a Kannada film titled Encounter Daya Nayak and a Hindi film Kagaar.
ACB has identified a person called Mansoor Hemjady who paid for the travel and hotel bills when Encounter Daya Nayak's crew were in Dubai for a shoot.
Mansoor also ran a website called dayanayk.com.
All bills of a former number 98200 00843 used by Nayak a couple of years back was paid by Bangalore-based Deve Paints, who also donated a large sum to build a school in Nayak's village in Karnataka.
