BANGALORE: Outgoing Chief Minister B S Yeddyurappa on Tuesday has approached the High Court challenging the Lokayukta report on illegal mining and questioned its recommendations to prosecute him under the provisions of the Prevention of Corruption Act.Yeddyurappa in the petition states that he has been "gravely aggrieved" by his indictment in the report.Yeddyurappa in his petition stated, "The report suffers from several legal infirmities and is unsustainable on several grounds." He added that the Lokayukta neither issued notice to him nor was he apprised of the matter before being indicted in the report.He alleged that the Lokayukta before submitting his report did not seek an explanation either from him or from his sons , and came to the conclusion that offences under the act have been committed. "This is contrary to the established tenets of law and therefore the action of the Lokayukta cannot be justified," the petitioner said."Submission of report without following the principles of natural justice is contrary to the law laid down in one of the cases by the High Court in 2004.The Lokayukta has exceeded the scope of investigation and has recommended for initiation of criminal proceedings against Yeddyurappa," the petition states.It also adds that the Lokayukta was urged to investigate into illegal mining and as such his recommendations against the CM are wholly without jurisdiction.Further stating that this has damaged his reputation, he averred that the procedure adopted by the Lokayukta violates the principles of natural justice.
