The AP High Court on Tuesday declared the election of Janardhan Thatraj from Kurupam (ST) Assembly constituency in Vizianagaram district as invalid.
It noted that Janardhan, who had contested on behalf of Congress party, does not belong to Scheduled Tribe but hails from a Kshatriya community.
Justice G Bhavani Prasad, in his judgement on an election petition filed by TDP candidate N Jaya Raju, who was defeated against Janardhan in 2009, declared Janardhan's victory as invalid after examining the records and evidences submitted by the petitioner.
The judge, however, rejected the request by Jaya Raju to declare him as elected from the constituency.
It is learnt that Janardhan will file a petition in the High Court on Wednesday seeking a stay on the implementation of the order to facilitate him to approach the Supreme Court.
Meanwhile, the judge on Tuesday dismissed another petition filed by an independent candidate SAK Moinuddin against the election of Anna Venkata Ram Babu, who had won as an MLA on PRP ticket from Giddalur as sembly segment i n Prakasam district.
The petitioner had alleged that Ram Babu had indulged in several irregularities and had suppressed facts that he was a contractor and had entered into various agreements with the government, while filing his nomination.
On the other hand, Ram Babu claimed that he has no contracts with the government at the time of filing of nomination and that the government has given required permissions for the purpose
