New Delhi: A court has said that drivers must slow down as they negotiate crossroads as it upheld the three-month jail term of a man convicted for killing one by his rash and negligent driving.
"It is duty of the driver of a motor vehicle to negotiate a crossroad at a slow speed and to notice any other vehicle passing," said Additional Sessions Judge Gautam Manan in his order delivered on Thursday but made available on Friday.
The court's remarks came while upholding three months jail term awarded to Shivdesh alias Shiv Kumar by a magisterial court November 2013. He has challenged the order.
According to prosecution, on April 16, 2010, Shivdesh was driving a car in rash and negligent manner at KM Chowk in sector 11-12 of Dwarka in south Delhi and hit a scooter being driven by Yoginder Singh. Singh succumbed to injuries.
Shivdesh told the court that the scooter was driven by Singh at a high speed, but the court noted that the testimony of witness and skid marks on the road went on to show that it was Shivdesh who was driving at a high speed at a crossroad.
"The fact of the case goes to show otherwise and demonstrates the rashness and negligence of the appellant while driving the offending vehicle which has resulted into the death of an innocent citizen," the court said.
