Court vacates injunction restraining Loyola, Stella Maris from charging more than the prescribed amount

An interim injunction granted earlier restraining Stella Maris College and Loyola College in the city from collecting fees in excess of the approved fee structure fixed by the government in respect of aided undergraduate and post-graduate courses was vacated by the Madras High Court on Friday.

In its common interim order passed on Friday, the first bench comprising Chief Justice MY Eqbal and Justice TS Sivagnanam said that “though the interim injunction was made absolute earlier, at this stage, we are of the definite opinion that such an order of interim injunction  should not continue any further and accordingly, the same stands vacated”.

Posting the matter for further hearing on October 29, the bench said that on that day, it would be decided as to whether the internal fight between the two groups of persons belonging to a church should be treated as public interest litigation.

Originally, the TN Catholic Minorities Welfare Association filed  a writ petition in 2008 for a direction to the government authorities to verify and monitor the fee collected by the management of Loyola College in so far as the aided course of study was concerned as per the norms fixed by the government and to appoint a permanent committee to determine the nature of fee to be levied by the colleges functioning within the State in general and by the Loyola College in particular.

The Federation of Catholic Faithful had prayed for a similar direction in respect of Stella Maris College.
