Nandakumar submitted that the further investigation report submitted by the CBI was not a true report and was not based on any effective investigation.On the CBI raising suspicion on the genuineness of Deepak Kumar, one of the key witnesses in the case, Nandakumar said that the prosecution which had produced the written statement of Deepak Kumar had later discarded it on the ground that there was no corroborative evidence. He said that the investigating agency had not subjected Deepak Kumar to further interrogation. Moreover, the alleged brokers - Dillep Rahulan and M A Nazar - have not been questioned, he deposed.Nandakumar alleged that the investigating officer in the case was changed on political patronage. Moreover, the MoU was signed overlooking the ban imposed by the Government of India. The government had prohibited signing of MoUs for new power projects in private sector.   The petitioners also argued that investigation should have been conducted against Sivadasa Menon as he was the Finance Minister at that time. They said that the contract would not have been signed if Kodiyeri Balakrishnan, a member of the KSEB during that period, had objected to it.Meanwhile, CBI Special Judge T S P Moosath said that it was for the investigating officials to decide on who were to be made the accused. The court cannot give directives in this regard.The CBI report, submitted to the court last week, had said that CPM state secretary Pinarayi Vijayan had not made any monetary benefit from the deal with SNC-Lavalin Company.
