Special Prosecutor 'Strongly Recommends' CBI to File Appeal in 2G Verdict

New Delhi: Just weeks after a special CBI court acquitted all accused in the 2G scam, the special public prosecutor (SPP) has told the CBI that there is “more than sufficient case” for appealing against the December 21 judgment.

A report in DNA quoted sources as saying that “senior Supreme Court advocate Anand Grover, who took over as SPP in 2014, has sent a detailed opinion to the CBI, “strongly recommending” that appeals be filed in the cases at the earliest.”

On December 21 last year, special CBI judge OP Saini acquitted all the accused, including former Union telecom minister A Raja and DMK Rajya Sabha MP Kanimozhi. The judge acquitted everyone saying that the there was a complete lack of evidence to prove the case.

Grover is reported to have written an opinion running into several pages while making a strong case for appeal, CBI sources were quoted as saying.

The SPP has told the CBI that the judge in fact failed to appreciate a substantial portion of the prosecution evidence on the issue of first come-first serve basis as well as selectively reading the evidence. The report further said that the court absolved Raja on the grounds that his decisions were based on advice from the officers of Department of Telecommunications, but at the same time the judge failed to appreciate the fact that the decision was of minister A Raja himself.

With regards to the alleged illegal gratification of Rs 200 crore given to Kalignar TV, the report said that SPP told the CBI “that the court analyzed it in a piecemeal and the reasoning of the same will be overturned in appeal.” Sources further told DNA that the special court seems to have applied different standards for prosecution witnesses and defence witnesses according to the SPP. The SPP is believed to have further told the agency that the special court has disregarded the evidence of crucial prosecution witnesses in their entirety.
