New Delhi: In a case of glaring medical negligence, the Delhi State Consumer Commission has directed a prominent private hospital and a surgeon to pay Rs 1 lakh as compensation to a patient, who was left completely deaf as the operation was performed on his right ear instead of defective left.

The ENT surgeon in Jaipur Golden Hospital (JGH) in Rohini in west Delhi had performed the operation of Lal Chand, a resident of Rohtak in Haryana 12 years ago. "Not only the career of the complainant has been ruined but his life has been snatched by the said doctors.

Had the doctors been careful and would have rendered services in a proper way then this calamity would not have fallen upon Chand," said Justice J D Kapoor, President of the Commission.

The Commission said the negligence on the part of the hospital and surgeon was that not only the wrong ear was operated, they did not had the necessary equipment for the purpose.

Lal, in his complaint, had alleged that he was suffering from severe pain in his left ear and was treated in various hospitals including the JGH.

Perusing the medical evidence, the Commission came to the conclusion the loss of hearing ability was more in the left ear than the right one and hence, the hospital erred in treating Chand.

The victim in 1992 was referred to the JGH by a consultant, who had conducted various tests about his ailment and diagonised that he required surgery of left ear. After regaining conciousness, Chand to his utter shock realised that instead of operation of the left ear, his right one went under the scalpel.
