Kapil Sibal said sending people booked under Section 66(A) to judicial custody is not in accordance with law and suggested that it could be 'illegal'.

New Delhi: Expressing concern over the arrest of a 21-year-old girl for posted comments against shutdown of Mumbai on social networking website Facebook, Telecom Minister Kapil Sibal on Monday said that Maharashtra Police mishandled the law and it's illegal to arrest people like this. He further said said the IT Act should not be used to 'throttle dissent'.

"I am deeply saddened (by the arrest of the two girls). It is just their point of view and enforcement of these laws are not to ban people from expressing their views," Sibal told CNN-IBN.

He said sending people booked under Section 66(A) to judicial custody is not in accordance with law and suggested that it could be 'illegal'.

Sibal said the law itself says it is a non-bailable offence and if a person is arrested under it, he should be given bail immediately. He said there was a need to educate enforcement agencies on how not to misuse the law and how better it can be enforced.

The Telecom Minister further said, "The law enforcement authorities have to be educate about the law 66 A."

The Telecom Minister also spoke about 2G auction, he said, "Every auction is different and dynamics of the market is different, so the results are different."

Attributing CAG's presumptive loss figure of Rs 1.76 lakh crore for the 'killing' of the telecom sector, Sibal said, "We have killed the spectrum market by giving these presumptive figures."
