BANGALORE: Karnataka High Court on Tuesday vacated the stay and other interim orders granted by it on Loakyukta investigation in the cases in which Katta Jagadish, son of former minister Katta Subramanya Naidu, and others had allegedly committed various irregularities in acquiring land for ITASKA Software.
Justice V Jagannathan observed, "Though the power of the High Court to quash the criminal proceedings is not taken away under the provisions of the Prevention of Corruption Act, the said power of the court cannot be executed to interfere with the power of the police to investigate into the cognisable offence."Notwithstanding the content of the proceedings no court shall withdraw the provisions of investigation. The Lokayukta position is indicative of investigative proceedings. Therefore, the question of staying the proceedings does not arise."
